Nope, you're under some impression that refurbished from a manufacturer means the same thing = it does not and it isn't governed by a set of laws in stone.

Refurbished doesn't follow the same trait right along the line of all appliances in terms of body wear.

Sebofan, a big company like Oreck would not send it out if it was less than perfect, just look at the fan when I took the thing apart!

Take photos of all the issues you have with the cleaner and open a case with Ebay.

I had to open a case after the seller didn't respond and very quickly, Ebay refunded me the cost of the vac and the postage as the seller never responded and I got to keep the cleaner.

I'd open a case/ and or return it. That is not a properly refurbished machine.

Funny, buying on eBay with a stock photo makes me think of an online blind date. Always ask for "proof pics".

File a NAD (not as described) complaint and return it. This is bullcrap.

I sell and BUY on ebay, as a seller I never use stock photos because I feel they are not an accurate representation of the item...especially if it has been used. As a buyer I pass on items like this or will email the seller asking for actual photos.

Seriously I think ebay should do away with the option for using "stock photos" for used/reconditioned items unless done by an authorized re-seller.

Sellers like this just give the rest of us a bad name.

Alex, as far as I'm concerned, you bought a Oreck off of Ebay. I think there's a good reason why some people refer to Ebay as Fleabay! If it was me seeing that listing, no way would have I gone on just the stock photo, I would have asked to see ACTUAL photos & if they refused or never replied back, no deal.

There's a little well-known saying called "Let the buyer beware!" If you were dumb enough to buy something manufacturer refurbished just trusting a stock photo, you deserved to get ripped off.

If it said manufacturer refurbished and I checked the feedback of other models the exact same that sold that recieved positive feedback, there was no reason for me to doubt it.

Alex for what it is worth I think you should pursue a claim but I think you should try and send it back for a full refund. To keep it and attempt to have a partial refund is going to make matters tricky. I would want to cut my loses.

Also Studley is a delightful part of the world. I am not at all sure how the location came into this.

I have never bought off of there.
Usually the shipping estimate is more than the item costs.
