Okay, so first of all, apologies for the cheesy thread title!
After cleaning the bin and cyclone out thoroughly, I have now been using the DC40 for a good few days and it is safe to say that I don't think there is a problem with the cyclones, like mentioned in an earlier thread.
The dust gets inside the filter compartment due to the bottom bin seal being covered in dust due to emptying. As you can see, the filter compartment is still clean and the bin has not been emptied yet, granted it is not full but there is a lot of fine dust collected in the bin from general cleaning and dusting my home.
None of the dust picked up is in the filter compartment, so, I can put this to bed now and I know it is because of the dust bin seal that the problem I suggested accrued.
Here is the Dyson and the inside of the filter compartment after a few days use picking up general dirt and dust, the bin is a bit dull now but that happens, should I buy it a new one? what do you think?
