Need Help Hoover Windtunnel Max Belt won't shut off in upright position

Help my Hoover windtunnel max bagged won't shut off in the upright position or when i use the belt shutoff switch I'd like help to fix it or to know what's wrong luckily it's still under warranty so worst come to worse I'll get another one i do plan on calling Hoover tomorrow but if anyone can help me before then I'd appreciate it
 
You are talking about the Max bagged upright you posted a picture of in the other thread, right?

I have good news and bad news. The good news is that your vacuum is working as it should. The bad news is, well, that your vacuum is working as it should.

See, I believe that these are not designed to shut off the brush when the vacuum is upright. Hoover models with the later pedal design would do this, but yours has the early design. Later vacuums had a peg on the side of the main body which would depress the pedal temporarily when the vacuum was upright. With yours, the only way to turn off the brush is by manually pressing the pedal.
 
Good news i have contacted Hoover and I've been redirected back to the Hoover ebay store either for replacement or for a warranty claim that they'll file on my behalf so wish me luck because even though I'm having this problem i really do like this vacuum and want it back in working order
 
Hi there. I don't know if you saw my reply. You will find that your replacement Hoover will do the same thing. These models do not turn off the brush when the vacuum is in the upright position. You must manually press the pedal to disengage it.
 
Ah. I mis-read your original post. You also said "or when I use the pedal." If the pedal isn't working at all, then yeah, it sounds like it is broken.

Sorry for the confusion.
 
This model is actually suppose to disengage when it's the upright position and up till recently did so it stopped doing so at the same time the pedal stopped doing so

UPDATE

Recently got a warranty repair from my local vacuum shop and they fixed it not stopping in the upright position but the brushroll continued to spin when the pedal was pressed so i took it back in and after about two weeks now the store called yesterday and said that Hoover sent in a new model which i just picked up i have assembled it but have yet to turn it on I'm honestly a little worried to because I don't want this to be the same thing over again any consolation anyone wants to give or past experiences with warranty replacements, should i be worried about the same thing happening or am i just being paranoid
